The admission of SROs in construction made it possible to simplify the licensing system as much as possible, without losing the quality of construction.

SRO approval in construction - what is it? This can be understood only by understanding why self-regulatory organizations (SROs) are created and how they work. They are formed by combining at least 25 members who are business entities. A professional community must have at least 100 members.

Thus, the community of construction organizations regulates the standards that ensure safety at construction sites, the quality of erected structuresand monitor their implementation. All the nuances of the work of such non-profit partnerships are regulated by federal law No. 315 “On Self-Regulatory Organizations.”

All self-regulatory organizations that have been registered and comply with the norms of the Law are included in the state register of permits for SROs in construction. It has all the self-regulatory organizations on the territory of the Russian Federation, uniting construction companies (SROS). Maintains the register of SROS Rostekhnadzor. It is important to remember that only SROS included in the state register have the right to issue permits.

How to get SRO approval and why you need it

If you do not get permission from the SRO, it will be impossible to get construction (in a row). After all, admission is a guarantee that the company carries out all work in accordance with the norms and requirements of the law. From the beginning of 2010 (since January 1), its presence is mandatory. Self-regulatory organizations issue permits for construction work only to their members, so the first task is to join one of them. Before joining, you need to know:

  • contribution amounts;
  • compliance of issued permits with the list of works carried out by the company;
  • list of documents to be submitted.

After submitting an application and a package of documents to the SRO, some time passes, necessary to verify the declared data, usually up to 30 days. If the level of qualification of employees, constituent and other documentation meet the requirements of the self-regulatory organization, then after payment of contributions within 3 daystolerance.

For how long is the permit issued

The duration of the permit is not limited by law. Its action is not limited to a territorial basis - the admission is valid throughout the Russian Federation. This is convenient, since you can join an SRO not on a regional basis, but choose the most convenient option.

However, there are two options for when a tolerance is considered invalid. The first is the exit of the business entity from the SRO. Then the community does not have the right to control the activity of the subject, and, accordingly, to guarantee the quality of his work and bear responsibility for them. The second option is a violation of the law.

A permit is required when ongoing construction or renovation work affects safety. How to find out what types of work require SRO construction permits? List No. 624 contains all construction work that requires a permit.

But in practice, if a company participates in tenders or works with a government customer, membership in a self-regulatory organization will most often be mandatory, even if the work performed is not in the List (at the request of the customer). Separately, it should be noted that if a company has expanded the list of services provided, and its SRO does not issue certificates for these types of certificates, then you can simultaneously join another self-regulatory organization.

Where clearance is not needed

In textThe Town Planning Code has a list of construction sites that do not need permits:

  • Garages for individuals who do not carry out business activities there.
  • Constructions that do not belong to capital facilities - stalls, sheds, etc.
  • Auxiliary use buildings.
  • Detached residential buildings up to 3 floors (individual building).
  • Detached residential buildings that have no more than 10 blocks and no more than 3 floors (blockade).
  • Residential buildings with no more than 4 blocks and 3 floors (multi-apartment).

A permit is not needed for changing capital construction objects, if they do not concern the restructuring of structural elements.

Admission for general contractors

Types of SRO permits in construction include the general contractor's permit. It is necessary if the company that received the contract engages third parties to perform part or all of the work (item 33 of the List - organization of construction with involved contractors). This document is necessary due to the fact that by concluding a general contract, the company assumes full responsibility for the quality of all work. Both those that he performs on his own, and those that are performed by a subcontractor.

The certificate of the general contractor allows you to carry out all activities in the legal field - to conclude contracts with other companies and monitor their activities. If the customer decides to engage subcontractors himself and coordinate their activities (i.e.perform the functions of a general contractor), then he also needs to join the association of general contractors and obtain the appropriate approval from the SRO in construction.

Admission to control

Construction control - technical supervision - can be carried out by organizations that have permission from the SRO in construction for this type of activity. In most cases, such a permit is obtained by the developer or general contractor. If there are no relevant specialists in the staff of the customer's company or the general contractor, then a third party is involved in the control.

Can foreign companies apply for SRO admission

The law provides that a foreign company can also obtain SRO approval in construction, and on a general basis. However, there is one caveat - the company is obliged to register a branch in Russia (not the entire company, but only its branch will receive admission and be a member of the SRO). Certificates of equivalence of diplomas of foreign specialists to diplomas of the state sample of the Russian Federation must also be provided.

The entry of foreign and Russian companies into the SRO means the implementation of their activities in the legal field.
