Performance of construction works implies high responsibility of performers. This is especially true for facilities whose operation is associated with the provision of accommodation for several families, hazardous industries and structures that are part of various infrastructure networks. Considerable risks in the implementation of such buildings and structures take place already at the design stage. In this regard, any organization planning to carry out activities in this area must issue an SRO permit for design work for legalization. Previously, start-up companies had to obtain a license, but in recent years, designers are required to register with self-regulatory organizations, that is, SROs.
What is an SRO?
A self-regulatory organization is an association of professionals that has a license to issue permits for certain types of work. In this case, the field of building design is considered, therefore, the members of the organization are represented by legal entities specializing in the development of project documentation. Actually, a member of the community is a priori a legal participant in the construction market in its segment. Currently, there are many SROs ondesign work, so problems with finding the right organization, as a rule, do not arise. At the same time, it is important to take into account the requirements that such communities put forward for candidates.
How is SRO different from licensing?
The abolition of the licensing procedure was received positively by many participants in the construction market, although changes in legislation subsequently turned out to be not so clear. The emergence of self-regulatory communities, on the one hand, has facilitated professional activity in the market, but on the other hand, it has formed a tough barrier against unscrupulous performers. Unlike a traditional license, an SRO for design work involves the regulation of the activities of its participants even after obtaining permits. The advantages of such control include assistance in legal matters, sometimes financing, as well as more advantageous positions in the market and priority in competitions for large orders. The disadvantages include making regular contributions, which are incomparable with the costs of the licensing procedure.
How to join a self-regulatory organization?
From a formal point of view, the entry procedure takes place in the form of a commission, which determines the applicant's compliance with the established requirements. The rules for accepting new members may vary depending on the particular SRO, but in most cases the following conditions must be met:
- Availability of specialized education. If we are talking about a company, then three of its employees must havediplomas of specialists in design. The same applies to persons joining SROs for design work as individual entrepreneurs.
- Availability of work experience. An individual entrepreneur, in turn, must have 10 years of experience in the field of design, and employees of the organization, at least 5 years.
List of documents for admission to the SRO
To obtain SRO approval for design work, you should be prepared to provide the following documents:
- Notarized certificate of assignment of PSRN (state registration).
- Certificate of registration with the IFTS.
- Charter of the organization.
- If available, Memorandum of Association must be provided.
- Extract from the Unified State Register of Legal Entities.
- Copies of diplomas of the head and employees, confirming the qualifications of the enterprise.
- Bank details of the organization.
- If the entry is planned to expand the scope of professional activity and the applicant for membership already has an SRO certificate for design work, then it is advisable to provide this document as well.
- Lease agreement for company premises or proof of ownership.
How much does it cost to join the community?
One of the disadvantages of participating in self-regulatory organizations is making monetary contributions to the compensation fund. There are several payment points, among which are the following:
- Initial membership fee upon joining the SROfor design work - an average of 50 thousand rubles at a time.
- Monthly membership fee - about 5 thousand rubles.
- Payment for the designer's insurance policy - no more than 3 thousand rubles.
Also, many organizations offer additional services for their members. These may include continuing education courses for designers, access to ISO certification documents that company clients may require, and other paid services.
What types of design does SRO legalize?
The area of design activity is quite extensive and not all types of work require mandatory approval from the performers. To understand whether an SRO is needed for design work in a particular case, you should familiarize yourself with the following list of operations for which you need to have a certificate:
- Preparation of project documentation when drawing up plans and diagrams of land plots, linear objects, as well as architectural and structural solutions.
- Preparation of information about engineering, internal technological networks, etc.
- Development of special sections in project documents. In this case, we can talk about defense complex facilities, industrial safety systems, hydraulic structures, etc.
- Designing measures to ensure fire safety and environmental protection.
- Inspection of building structures and structures.
What jobs do not require SRO approval?
For activities that in the future do not have a sufficient impact on the reliability of capital structures, there are no special requirements for the admission of SROs to design work. The types of work in this category can be represented by the following list:
- Construction of garages, arrangement of garden and household plots, the operation of which is not related to entrepreneurial activity.
- Design of kiosks, hinged and other structures not related to capital construction projects.
- Design and construction of auxiliary facilities.
- Drawing up a plan for the reconstruction of capital facilities, provided that the changes made do not affect the structural basis of the building and, accordingly, do not affect the characteristics of its reliability and safety.
- Design of internal power supply systems.
- Creating landscape and interior design projects.
Conclusion
Despite the fact that SROs maintain strict regulations when issuing permits for design work, members of such associations have many advantages. For example, by contacting a design self-regulatory organization, the list of work of which with tolerances goes far beyond the scope of the intended activity, the participant also receives the opportunity to improve his qualifications. In addition, members of associations are protected by legal experts, receive insurance and access to profitable tenders. One way or another, in the endthe client wins, to cooperation with which real specialists were admitted. As it was originally supposed, SRO is still a tool for careful selection of participants in the construction market with the provision of the necessary permits.
