"The manure tax will appear in Russia from September 1", "Legal lawlessness", "They went crazy". These and many other phrases could be heard and seen in the vastness of the information space. The opposition publicly began to inflate the news among the electorate, the Ukrainian media began to laugh at the fact that we have a tax on manure.

Many patriots did not believe them, they began to claim that this was an informational pre-election stuffing of misinformation in order to obtain additional votes. We tried to understand the problem objectively. Has Russia really introduced a tax on manure? Was this innovation a surprise for entrepreneurs? About everything about this in order.

Dung tax - myth or reality?

When the inscription “the law“on manure”appears on some resources, it means the Federal Law “On Production and Consumption Waste”, now well-known in our country, adopted back in 2014. From now on, we will call it Law.

It's not even about him, but about the amendments to him, whichequated manure from animals and bird droppings to industrial waste of the 3rd and 4th hazard class. What does it mean? And the fact that manure is now considered not very dangerous in the sense that it does not immediately harm, but also not safe to just throw tons of it into the street.

In fact, the so-called "dung tax" does not exist in Russia. Licensing of activities is being introduced, but this is somewhat different. But we will talk about this in more detail below.

All evil in the world is well-intentioned

Legislators and ministers scare with numbers. Like, millions of tons of manure from farms harm our ecology. Producers of pigs are fed with chemical "poison", which gets through "harmful waste" into the soil, thereby polluting it. We don’t know about others, but we have a few questions:

  1. If legislators care so much about the soil and do not allow chemistry in manure, then why are they allowed to feed animals with this very “poison”? Why is the meat of birds stuffed with chemicals on the shelves in stores? That is, it is possible to feed people with such "chemical carcasses", but it is dangerous to throw away waste after them without special treatment?
  2. Why license? It turns out that in order to protect our ecology, it is necessary to obtain a bunch of permits? Why not set up public waste disposal centers to support agriculture?
  3. Why, before crises and budget deficits, for many years, manure was always fertilizer, and now it has suddenly become “hazardous waste”? And the volume of production in agriculture at the same Soviet time wasmuch higher than now. Of course there was chemistry. But why then various checks of Rospotrebnadzor, veterinarians, etc.? Why is manure from all manufacturers “one size fits all” called hazardous waste?

Money doesn't smell

Many experts have only one conclusion - “money has no smell”. The manure production tax is needed to extort money from entrepreneurs. The fact is that the goods of enterprises that sell manure as an organic fertilizer are in great demand. Humus is especially valued in Central Russia. This is a whole industry in the economy. Many small individual entrepreneurs live on this. In addition, animal husbandry is becoming more profitable. In addition to milk and meat, many enterprising farmers also sell manure. Apparently, this decided to stop our state and impose additional fees.

Trouble crept up unnoticed?

But you can't say that the Law fell like a bolt from the blue. It was accepted back in December 2014. It was assumed that the tax on manure in Russia (a license must be obtained by enterprises that conduct relevant activities) will appear from January 1, 2016. But manufacturers by this time had not prepared for the new requirements and bombarded the Ministry of Natural Resources of the Russian Federation with letters of explanation.

Are you crazy?

Many politicians and even heads of regions perceived the Law as anti-people. But we will not enter into discussions on this matter. Let's just say that as of July 1, the situation with licensing has not improved. The example of Tatarstan is indicative. Out of 800none of the agricultural enterprises received a license. One firm from Naberezhnye Chelny submitted an application, but was rejected due to an insufficient set of documents.

What to do with the only cow?

But the so-called manure tax in the Russian Federation will not affect personal subsidiary plots. This is for now. What will happen tomorrow, only God knows. Taxes on air, pipe, wind, thunderstorms no longer seem to be out of the realm of fantasy. But for now, the grandmother, who has only one or two cows in her personal subsidiary plot, can sleep peacefully. No tax on manure threatens her. Licensing is required only for legal entities.

Issue price

The problem is that, according to experts, an impressive amount will be needed for manufacturers. From 100 thousand to 1.5 million rubles. - to small producers for waste collection, and from 400 thousand to 20 million rubles. - for large ones who will utilize this manure.

What do you need money for?

Of course, the factor of corruption and bureaucracy does not count. But maybe the spread of the amount among specialists from 100 to 400 thousand rubles suggests this. For large entrepreneurs, it reaches 20 million. But why do we need money? We will answer - significant expenses will be required to implement the requirements of the Law:

  • For training. Now every tractor operator in the village who transports manure must take courses to be allowed to work with hazardous waste. Some mechanics, of course, will be very surprised by this. They say that they have been transported all their lives, and now this is a dangerous production. Naturally, these courseswill be paid. For example, in the Belgorod region they cost around 6-10 thousand rubles. But how much their price will be in other regions and how long the documents will be issued is unknown.
  • For transport equipment. The law provides for special signs and containers.
  • Sanitary and epidemiological conclusions on facilities for the collection, storage and disposal (neutralization) of waste.

What to do in this situation? Storing manure for more than 11 months necessarily falls under a license, without which a fine is provided. In addition, judging by the Law, any transportation will also fall under it. That is, if an enterprise has a temporary storage facility a few kilometers from the farm, then it also does not have the right to transport pig waste without special permission.

The Law stipulates "registration of a license for the collection, transportation, processing, disposal, disposal, disposal of waste of I-IV classes." This means that an auxiliary worker on a pig farm must also undergo a training procedure for working with dangerous production. After all, he can collect manure from cows or pigs. And the Law says so: “collection.”

The tractor driver also has no right to transport it even to the place where a special operator will come for it, if the enterprise does not have a license, and the employee does not have permits.

All theseactions are actually illegal and subject to fines. And their sums are impressive. From 10 to 30 thousand rubles for an official, from 100 to 250 thousand - for a legal entity. How the checking services will react is still unclear.

Gave manure - get article?

If farmers suddenly sell (and even donate, judging by the Law) manure to another person, then criminal liability may arise for this. This refers to illegal entrepreneurship (Article 171 of the Criminal Code of the Russian Federation). The Law says that a license is required "when a legal entity sells … manure, litter, other organic substances and materials to third parties on a contractual (including free of charge) basis."

Conclusion: even free transfer of manure must be licensed. And selling without permission is illegal business. It is clear from the Law that “implementation” also includes “gratuitous basis”.

Who is to blame and what to do?

Our two questions again. Who is to blame? This, of course, is all of us, citizens of the country. Our deputies do not come from Mars. We choose them in elections. But what to do? Here are some options:

  1. Combine several small entrepreneurs into a single "holding" to obtain their own license.
  2. Conclude a special agreement with the operator who has it. They will impose a tax on manure. In all likelihood, in this case, it falls under the category of "environmental fee". Its amount depends on the costs of a particular operator and nowhereregulated. That is, if a farmer is told 5 thousand rubles per ton, but there are no other companies that have licenses, then they will have to pay as much as they say. The fines will be more expensive. And now an interesting question. Will the price for the final consumer in this case decrease or increase?
  3. Put the whole livestock under the knife and declare the enterprise bankrupt. So the tax on manure in Russia will ruin many unprofitable agricultural enterprises.
  4. Don't have a license and break the Law. We talked about the consequences above.

But let's say that before you start running around the authorities and departments (and this is not easy), you need to prepare a technological base:

  • Prepare specially equipped and labeled vehicles.
  • Prepare and include a waste disposal facility in the state register of such facilities. And these are all kinds of approvals for environmental reviews, inspections of the SES, the Ministry of Natural Resources, and so on. In general, it is not an easy task. The case is quite expensive. Only manure must be stored for at least 12 months on a site equipped with hard surface.
  • Obtain a personnel certificate to work with hazardous waste.

In addition, after obtaining a license, it is necessary to keep a record of manure, monitor the environment, process with special means, store a certain amounttime (cow dung, for example, from 12 months) and much more.
