UTII is a special taxation system in which an entrepreneur pays taxes based not on actual, but on imputed (potentially possible) income. Imputed income is regulated by the state and is established, in accordance with the legislative acts of the Russian Federation, depending on a particular type of activity. The main factor determining this income is a set of such physical indicators of activity as the number of employees, the area of warehouse space, the area of trading floors, the number of vehicles.
About what specific types of activities are subject to imputed tax, it is prescribed in the legislative acts of the city or district. Local authorities independently control this issue and at the city level determine the deadline for paying UTII and what activities are subject to UTII and which are not.
Imputed income tax returns, like any other declarations, are completed at the end of the tax period.
UTII ratecalculated by local authorities, based on the territory and types of activities. The payment of tax on potential income for individual entrepreneurs replaces the mandatory payment of personal income tax and property tax owned by an individual, for legal entities - income tax, value added tax and organization property. However, the payment of UTII, according to Russian legislation in the field of taxes, does not exempt from paying transport and land taxes, as well as from paying state duties and excises.
The deadline for filing UTII is the twentieth day of the first month of the next quarter (tax period). The form by which the tax return on imputed income is filled out was approved on January 23, 2012 by order of the Federal Tax Service of the Russian Federation. The rate of this single state tax is equal to fifteen percent of the potential income. UTII is calculated as the product of the tax rate and the tax base, that is, the value of imputed income.
The deadline for paying UTII to the budget system of the Russian Federation is no later than the twenty-fifth day of the first month of the upcoming quarter (tax period). The tax is paid by the taxpayer at the place of registration with the local tax authority. For example, the deadline for paying UTII for the first quarter of 2013 should not be later than April 25, 2013. At the same time, tax returns for the first quarter of 2013 are submitted no later than April 20.
It is important to note that the procedure and deadline for paying UTII, according toprinciples of taxation of the Russian Federation, imply a mandatory quarterly payment of tax. In case of violation of the law and late payment, both individual entrepreneurs (individuals) and organizations (legal entities) are subject to pen alties. For non-compliance with the terms of payment and violation of the norms of tax legislation, a fine is charged, which is one three hundredth of the refinancing rate of the Central Bank of Russia. The timeliness of the submission of tax returns and the timing of payment of UTII taxes are regulated by paragraph one of Article No. 346.32 of the Russian Tax Code.
